ARTICLE - RESIDENCE PERMIT PROCEDURES

PROCEDURES FOR OBTAINING A RESIDENCE PERMIT IN HAITI
(Haiti Libre) -

Following the notice dated January 27, 2012, issued by the Ministry of Interior, of Territorial Collectivities and National Defense, to the attention of foreign nationals staying for more than 90 days in Haiti or living on national soil, concerning the formal obligation to obtain a residence permit and to legalize their status, the services of the Ministry inform the person concerned, of the steps and documents required to apply for a residence permit.

To be holder of a residence permit, it is necessary to/to have:

1. Write a letter requesting an application for a residence permit to the Directorate of Immigration and Emigration by notifying the reasons.

2. A photocopy of the biographical page of passport of the applicant

3. A letter of employment from theirs employer or the person who supports them, guaranteeing the stay of the foreigner in Haiti and repatriation if necessary.

4. A Medical Certificate not older than thirty (30) days.

5. Two (2) copies of the photograph of the person (format: Passport Photo and color).

6. A photocopy of boarding card obtained during its last re-entry to the country

7. A photocopy of Birth Certificate (French translation required).

8. A bank statement from a bank operating in Haiti.

9. A criminal record (Country of origin of recent date).

10. A sum of five thousand gourdes (5,000 gourdes) to pay in 'check of direction' to the order of the Treasury

Note that when filing documents, the applicant will have to be interviewed and then to complete the application for a residence permit. His fingerprints will be taken and stored in the database of the institution. In reference to Article 34, the annual application for renewal of a residence permit will be accompanied by the slip proving payment of income tax fees for the fiscal year elapsed.

Law of August 12, 2002 granting certain favors to native-born Haitians enjoying another nationality and to their descendants :

Article 1 - Every native-born Haitians enjoying another nationality and its descendants are:

a) Exempted from visa to enter and exit Haitien of Haiti;

b) Exempted from the formalities of residence permits and payment of related taxes;

c) Exempted from the formalities of a work permit, employment permit and payment of related taxes;

d) Exempted from the formalities related to the license of foreigners and payment of related taxes;

e) Eligible both at the civil service and the employment market, unless in cases expressly prohibited by the Constitution;

f) Exempted from the authorization of the Ministry of Justice to acquire any real estate properties;

g) Authorized to acquire in urban areas any real property with an area not exceeding 3 ha 87, quivalent to three (3) carreaux of land;

h) Entitled to fully enjoy the same rights of succession as all Haitians;

i) Authorized, in case of auction by contract (voie parée), to proclaim to be a purchaser of the assigned property to the payment of its debt and statements of orders that can be made in its favor;
